Request for clarification: European Commission statement concerning sex self-determination

We have asked the European Commission to clarify the legal basis for public statements asserting a right to self-determine one’s sex.

For too long, public statements by EU officials suggesting that individuals can choose or change their sex, and that such a position is supported by EU law, have gone unexamined. We have therefore submitted a formal request for clarification to the European Commission.

We ask the Commission to explain the legal basis for such assertions, their compatibility with EU law and Member State competences and their implications for sex-based data collection and reporting across the European Union.

The statements in question were made during a European Commission webinar on gender mainstreaming in project proposals, intended to guide applicants for EU funding (12 March 2024). The relevant passage can be viewed in the publicly available recording (at 15:20).
